San Francisco Golden Gate Park drones banned or not


So I spent some time talking to the park ranger department about weather or not drones are banned in the golden gate park, according to the rangers, they are banned, but they are quoting the outdated "San Francisco Park Code" (available at https://ift.tt/2N1ODbs ) to back up this ban, specifically:​SEC. 3.09. AIRPLANES, HELICOPTERS, HOT AIR BALLOONS, ETC. PROHIBITED. No person shall launch nor land any air- plane, helicopter, parachute, hang glider, hot air balloon, nor any other machine or apparatus of aviation in any park, nor shall any person bring into any park any balloon with a diameter of more than six feet or a gas capacity of more than 115 cubic feet, without permission of the Recre- ation and Park Department. This Section shall not be applicable to a helicopter being used to transport persons or supplies because of an emer- gency situation. (Added by Ord. 603-81, App. 12/18/81)and:SEC. 7.04. ADDITIONAL ACTIVITIES REQUIRING PERMITS. (a) Attention is called to other provisions of this Code which require persons engaging in certain activities to obtain a permit, including, but not limited to, the following: (1) Launching or landing any airplane, helicopter, parachute, hang glider, hot air balloon or other machine or apparatus of aviation, in any park, or bringing into a park any balloon with a diameter of more than six feet or a gas capacity of more than 115 cubic feet (See Section 3.09);Now, under this particular regulation, I can't see how they can possibly enforce their supposed 'ban', the ranger claims that drones fall under "Machine or apparatus of aviation"​All reference maps I can find, including airmaps, Hover and the FAA's V4UFly app mark Golden gate park as safe zone, and even if the above is used to enforce the ban, the only thing that actually requires a permit according to that text is landing or taking off, so, as long as you take off from outside the park you can fly in the park (which is stupid anyways)? I could also argue that this particular regulation is clearly intended for manned aircraft, NOT unmanned aircraft​I'm trying to figure out a way to pre-emptively have this ruled unenforceable before going to GG and having my brand new Mavic 2 Pro confiscated, any thoughts/suggestions?? via /r/drones https://ift.tt/2NA2TVK
